Working groups: Cartels
Globalization has created world-wide markets for many products and services. It also presents certain challenges to competition authorities. As markets are increasingly global, competition authorities are faced with cartel activity that is, likewise, increasingly cross-border.
At the heart of antitrust enforcement is the battle against hardcore cartels directed at price fixing, bid rigging, market sharing and market allocations.
Therefore, ICN members at the ICN's Third Annual Conference in Seoul resolved to set up a Cartel Working Group. The mandate of the Cartel Working Group is to address the challenges of anti-cartel enforcement, both domestically and internationally, across the entire range of ICN members and amongst agencies with differing levels of experience.
The Working Group attaches particular importance to responding to the interests and needs of agencies from developing and transition economies.
ICN Members at the Seoul Annual Conference asked DG Competition of the European Commission, and the Hungarian Office of Economic Competition, to co-chair this project.

During its first year, the ICN Cartel Working Group will focus on the following two projects:
Subgroup 1: General Framework
The General Framework subgroup will address the legal and conceptual challenges of anti-cartel enforcement. In the course of its work related to the necessity and benefits of the fight against cartels, the subgroup will strive to build on, and proceed beyond, the work undertaken in other forums; and respond to the interests and needs of agencies new to cartel enforcement.
The focus of the General Framework subgroup is the scope of anti-cartel behavior, the support for anti-cartel enforcement, and the basic elements of effective institutional frameworks used to detect, investigate and punish hard core cartel conduct.

Subgroup 2: Enforcement Techniques
The objective of this Subgroup is to help competition agencies to improve their enforcement techniques. It will aim to enhance the effectiveness of anti-cartel enforcement by identifying and sharing specific investigative techniques amongst agencies with differing levels of experience.
The work of this Subgroup could evolve from a number of general questions , including:
What constraints do antitrust enforcers face? What is the enforcement experience in anti-cartel cases? What can be done to improve the ability of enforcers to share information and coordinate their enforcement activities? This Subgroup could further proceed to address more specific practical and technical questions and supplement the work that has so far been done in the International Cartels Workshops . This Subgroup could study various specific investigative techniques that would enhance enforcement effectiveness such as:
standard of proof compulsory requests computer forensics surprise inspections/dawn raids surveillance techniques interviewing skills preventing the destruction of evidence leniency cooperation, including e.g., model waivers for the exchange of information The format of the output of this Subgroup remains to be decided, but could include preparing a virtual library of resource materials relevant to its mandate.
It is envisaged that this Subgroup would also have a steering role for the organisation of the Annual International Cartel Workshop. It would make proposals for the content of the Workshop and possibly also develop a multi-year plan for the Workshop. This could enhance the coherence and quality of the annual workshops and help to ensure that workshops respond to the needs of ICN's members. It is clear, however, that the host of an Annual Workshop will always have a prominent role in the organisation of the event .. Output generated in Subgroup 1 can influence the planning of the Workshop agendas performed in Subgroup 2.
