He is 100% WRONG on this "explanation".
My web pictures were on my "free" web site and the page was CLEARLY marked
that they were copyrighted by me.
Free has nothing to do with it.
Stealing them for your own use is a violation of US copyright law.

At least two other famous photographers are now planning legal action
against Bill.

virtually NONE of the pictures are legitimate submissions by the actual
owner of the picture.

he also uses pages from numerous "" sites.
That was my second BIG objection to his use of my pictures....
I do not want them associated with cocazilla.com [sp?] pictures.

And you may well want to hold him responsible, and I may not like the
fact that this happened (or even that those pictures are there). In
the broader context of a world with horrors like the Tsunami and the
ongoing crises in the Congo and Sudan, what I think about being
responsible, one to another, seems to not matter much.

While I understand how you feel (because I would feel the same) and
that this matters to you, that does not mean Bill is responsible in
any legal way or would be held as responsible by a broader public,
some of whom would jail you for what you put on your web site if they
could find a way to hold *you* responsible to them for that.

BTW, I liked your web site very much. Thank you.

I am sorry to hear that. He sent out a letter indicating he was ready,
willing and able to remove such material. What you say is
disappointing. I hope he has changed his policy since your encounter.

Free has a lot to do with it. See my reply to Dan on rec.nude.

Making a copy is not theft.

When you publish something to the public, you give up rights. The
reason you have a copyright is to enable you to publish without giving
up *all* rights. You may sue for violations of your copyright outside
of "fair use" but that does not include all use.

Even if it were to be a copyright violation, that is a violation of
rights granted to you by the copyright law (that you would not
otherwise have), not a theft.

The photographers may have a case if they can prove damages - that in
some way these actions hurt their ability to sell their images.
Otherwise, they will just end up spending their money for nothing,
even if they cost Bill in the process, and he may win and cost them.

How do you know this? I am asking. I can go out there and see for
myself if you tell me what to look for to determine this. As things
stand, I have not been there, but I would have no issue going there.

Then you may have a case for damages if there are pictures that would
be considered ual as opposed to simple nudity. Again, I would ask
how you know, because it is a serious charge IMHO. I have posted to
the message boards on that site and get their eMail. I will want to
withdraw my membership immediately if what you say is true.

From what I've seen none have been taken down. When he's told to remove them
he just removes the person that is complaining and leaves the pictures.

That is very true. I doubt that hardly any of them were obtained in a legal
fashion.
Very many have watermarks on them from other sites and many of those sites
are sites. I wrote to a few of them asking if they had given permission
to Bill's site to post them and they said they had not.
